Terms of Service

1. Acceptance of Terms

By requesting, scheduling, or accepting electrical services from Precision Power Services ("Precision Power," "we," "us," or "our"), you ("the Customer") agree to these Terms of Service. If you do not agree to these terms, please do not request or accept services from us.

2. Services

Precision Power provides licensed electrical contracting services including but not limited to panel upgrades, residential and commercial wiring, EV charger installation, generator installation, heat pump electrical work, safety inspections, smart home wiring, and emergency electrical repair. All work is performed by or under the supervision of a Vermont-licensed electrician.

3. Estimates and Pricing

Estimates provided before work begins are good-faith approximations based on the information available at the time. Actual costs may vary if unforeseen conditions, code requirements, or scope changes arise during the project. If the scope of work changes, we will communicate the additional cost before proceeding whenever possible. Written change orders may be required for significant changes.

4. Invoicing and Payment Terms

Invoices are due and payable upon receipt unless otherwise stated on the invoice or agreed in writing. For larger projects, a deposit may be required before work begins, and progress payments may be scheduled at project milestones. Any payment plan or extended terms must be agreed to in writing before work commences.

5. Late Payments and Interest

Invoices not paid within thirty (30) days of the invoice date are considered past due. Past-due balances accrue interest at a rate of one and one-half percent (1.5%) per month (18% annually) or the maximum rate permitted by Vermont law, whichever is lower. Interest accrues from the original due date until the balance is paid in full.

6. Collection Costs and Attorney's Fees

If your account is referred to collection or legal action is required to recover unpaid balances, you are responsible for all reasonable costs of collection, including attorney's fees, court costs, and filing fees, to the fullest extent permitted by Vermont law.

7. Mechanic's Lien Rights

Under Vermont law (9 V.S.A. §§ 1921–1925), contractors who furnish labor or materials for the improvement of real property have the right to file a mechanic's lien against the property to secure payment for unpaid invoices. By accepting services from Precision Power, you acknowledge and agree that:

• Precision Power reserves the right to pursue mechanic's lien rights against any property where work was performed or materials were supplied if payment is not received.
• A notice of lien may be filed with the town clerk in the town where the property is located within one hundred eighty (180) days from the date payment became due, as required by 9 V.S.A. § 1921(c).
• If a lien is filed, Precision Power may commence a civil action to enforce the lien within the time period required by 9 V.S.A. § 1924.
• You are responsible for all costs associated with filing and enforcing a lien, including recording fees, attorney's fees, and court costs, to the extent permitted by law.
• This clause does not waive any defenses you may have under Vermont law, nor does it limit Precision Power's other remedies for collecting unpaid balances.

Important: Vermont law sets strict deadlines for filing mechanic's liens. The 180-day filing period begins when payment becomes due — not when work is completed. Precision Power will make reasonable efforts to notify you before filing a lien, but failure to receive notice does not extend the statutory deadline. 8. Warranties and Liability

Precision Power warrants that all work will be performed in a workmanlike manner consistent with industry standards and applicable Vermont electrical codes. Warranty claims must be reported within one (1) year of the date work was completed. This warranty does not cover damage caused by misuse, modification by others, acts of nature, or normal wear and tear. Precision Power's liability for any claim is limited to the cost of the work performed.

9. Change Orders

Any changes to the agreed scope of work must be documented in a written change order signed by the Customer before the additional work begins. Verbal requests for additional work may be accommodated, but the Customer remains responsible for payment of any work actually performed.

10. Cancellation and Rescheduling

Appointments can be rescheduled or cancelled by calling (802) 417-0587. Cancellations with less than 24 hours' notice may be subject to a service call fee. If work has already begun and is cancelled by the Customer, the Customer is responsible for payment of all labor and materials provided up to the cancellation date.

11. Property Access and Condition

The Customer agrees to provide reasonable access to the work area, including clear pathways and a safe working environment. Precision Power is not responsible for damage to property that was not disclosed or was concealed, or for working conditions that were not safe or accessible. The Customer is responsible for moving furniture, fixtures, or belongings that obstruct the work area.

12. Insurance

Precision Power maintains general liability insurance. Certificates of insurance are available upon request.

13. Governing Law

These Terms of Service are governed by the laws of the State of Vermont. Any disputes arising from these terms or from services provided by Precision Power shall be resolved in the appropriate Vermont courts.

14. Changes to These Terms

Precision Power may update these Terms of Service at any time. Changes are effective when posted on this page. The effective date at the top of this page indicates the last revision.
